Duane Peters' Disaster Records has announced the lineup for the 2005 Old Skars & Upstarts Tour. Starting on September 2nd a line up of Die Hunns, the Kings of Nuthin', the Black Halos and the Angel City Outcasts will be on the road throughout the US. The dates and routing have been announced, so click below for that info. Venues are expected to be confirmed shortly.
Also in September Disaster Records will release the compilation of the same name. Old Skars and Upstarts 505 will feature 30 rare and unreleased songs from bands including Turbonegro, the Briefs, Angel City Outcasts, the Epoxies, the Black Halos, Die Hunns, Mad Sin, Amazombies, the Bones, Street Dogs, the Stitches, the Kings of Nuthin', U.S. Bombs, the Skulls, Roger Miret, the Adicts, HollowPoints, Civet, the Riverboat Gamblers, the Duane Peters Gunfight and the Ducky Boys.

The event is scheduled to take place on August 20th and 21st at Plainfield Station in Woodland, California. Among the bands scheduled to perform are The Forgotten (BYO), Whiskey Rebels (GMM), The Havoc (Punkcore), Red Tape (Roadrunner), Killing the Dream (Deathwish) and Angel City Outcasts (Thorp). A number of news outlets and readers are reporting that Sony/BMG has settled the so-called "Payola" case with New York attorney general Elliott Spitzer. According to Spitzer's office, the lawsuit was motivated by
outright bribes to radio programmers, including expensive vacation packages, electronics, and other valuable items; contest giveaways for stations' listening audiences; and payments for 'spin programs', airplay under the guise of advertising. To settle the suit, Sony agreed to pay $10 million yesterday to the state to be used for "nonprofit music-education programs."
According to some unnamed sources, the pay-for-play was quite overt with one Sony executive saying that "Please be advised that in this week's Jennifer Lopez Top 40 Spin Increase of 236 we bought 63 spins at a cost of $3,600." Spitzer has handed over his evidence against Sony to a FCC commission, which could penalize any stations found to have been willing partners in payola.
The music conglomerate includes a wide variety of artists under it's umbrella. From mainstream rock acts like Audioslave and Foo Fighters to genre acts like The Blood Brothers and Anti-Flag.

SaveCBGB.org has announced a series of shows in honor of the legendary CBGB's nightclub. Among the band scheduled to play this August are 70s punk legends the Dead Boys, and performances by Gorilla Biscuits, and Circle Jerks as well as newer acts like Against Me!. The goal of the performances is to help generate support and momentum hopefully leading to a renewed lease.
Also expected in September are performances from The Exploited, Adolescents, Conflict, Verbal Abuse, Today is The Day, Circle of Dead Children, Dayglo Abortions, Adolyne, Sick of It All, Dr. Know, Circle Jerks, Channel 3, DI, and Zero Boys. Also yet to be confirmed is the specific date for the performance from Kid Dynamite.
The legendary NYC club which played home to bands like the Ramones, Patti Smith, Blondie, Television and literally hundreds of others artists through the years may be forced to close its doors. The situation arose due to a dispute with Bowery Residents Committee which holds a 45-year lease on the building. CBGB's is their lone commercial tenant; their rent feud dates back five years, when the committee went to court to collect more than $300,000 in back rent from the club. The Bowery Residents Committee which is 75% funded by the city of New York has listed the property on the Real Estate MLS for anyone else who wishes to rent 313 and 315 Bowery.
Limited amount of tickets will start being made available on July 26th through ticketweb

Megadeth's Mustaine Sues Former Bassist Megadeth lead singer Dave Mustaine has sued the band's former bass player for allegedly using the name of the group without permission in an advertisement for musical equipment.
The suit filed yesterday (July 25) in Los Angeles Superior Court claims Mustaine and David Ellefson entered into a settlement agreement in February that restricts the guitarist's use of the band name. Ellefson left Megadeth in 2002 after 17 years in the band.
"Ellefson shall not use, or authorize anyone else to use, the work or mark 'Megadeth" to advertise, market or promote any person, band, company, organization, product or services without Megadeth's prior express written permission," according to the lawsuit.
Mustaine said an ad in this month's issue of Bass Player magazine features Ellefson holding a pedal tuner for bass guitars and includes the names of several bands he is involved with, including Megadeth.
Mustaine is seeking unspecified compensatory, punitive and exemplary damages.
In related news, Megadeth has parted ways with Sanctuary Records, which released its last three albums.

In Memoriam John Tamas of Palehorse (1979-2005)
John Tamas, guitarist of Connecticut-based Palehorse has passed away. His label, Martyr issued the following statement from his bandmates:
As most of you may know by now, a close personal friend, brother, and band mate passed away [Monday]. There are no words to express the shock and despair we are all feeling right now. John Tamas grew up with all of us to the tune of 15+ years. He was a part of the Connecticut Hardcore scene for the past 12 years and has made a lasting impact in all of our lives. We would like to send our utmost gratitude to those who have been there for us in this tragic time. Your words, emails, phone calls, and tears have reopened our eyes to hardcore and what hardcore is all about. We have been surrounded by loved ones all day. Thank you so much. Our deepest condolences go out to John's family, friends and fans.

Against Me! track listing for new album
Fat has released the artwork and track listing for Searching For A Former Clarity, the upcoming full length from Against Me! The record is the follow up to As the Eternal Cowboy and was produced by J..Robbins. A track from the album recently appeared on the Rock Against Floyd compilation which was distributed at the Warped Tour this summer.
The band also released the We're Never Going Home DVD last year, and has announced US tour dates which take them through the release of Clarity and into the fall. Among them are shows on the previously announced tour featuring Green Day and Jimmy Eat World.
The record is due out September 6th.

Punk acts young, old and reunited have pledged their support for embattled New York club CBGB, which is fighting to renew a soon-to-expire lease and may be forced to close up shop entirely. Artists such as the Misfits, Thursday, Against Me, Liars, Dead Boys, Gorilla Biscuits and the Vandals will perform at a series of benefit concerts at the club in the coming weeks to raise funds for the effort. The Save CBGB fund is earmarked for the club's legal fees as it lobbies its landlord, the Bowery Residents Committee (BRC), a not-for-profit organization that provides services and shelter to homeless and disabled New Yorkers. Additional artists set to appear include Living Colour, Flipper, Kid Dynamite, Bush Tetras, Chevelle, the Exit and World Inferno Friendship Society. Beyond the shows, acts such as the Bangles, Elvis Costello and Sting have donated memorabilia for a fundraising auction, and the E Street Band's Steven Van Zandt has made efforts to personally negotiate with the BRC. Former Talking Heads vocalist David Byrne has also offered to assist in mediation. "CBGBs supports the BRC's fight to help the homeless -- we just want our lease renewed to keep this historic venue in its original place," says CBGB owner Hilly Kristal. The conflict stems from a series of rent hikes. According to CBGB spokesperson Scott Goodstein, on several occasions the BRC raised the rent on CBGB's home at 313 Bowery without properly informing the club, later bringing the issue to court in order to collect interest. Sony BMG Agrees to $10M 'Payola' SettlementOne of the nation's biggest music companies, Sony BMG Music Entertainment, agreed Monday to pay $10 million and to stop paying radio station employees to feature its artists to settle an investigation by New York Attorney General Eliot Spitzer. The agreement resulted from Spitzer's investigation of suspected "pay for play" practices in the music industry. A Sony BMG spokesman didn't immediately respond to a request for comment. But Spitzer said Sony BMG has agreed to hire a compliance officer to monitor promotion practices and to issue a statement acknowledging "improper conduct" and pledging higher standards. He commended the company for its cooperation. "Our investigation shows that, contrary to listener expectations that songs are selected for air play based on artistic merit and popularity, air time is often determined by undisclosed payoffs to radio stations and their employees," Spitzer said. "This agreement is a model for breaking the pervasive influence of bribes in the industry." Spitzer had requested documents and information from EMI, Warner Music Group, Vivendi Universal SA's Universal Music Group as well as from Sony BMG, which is a joint venture of Sony Corp (NYSE:SNE - news). and Bertelsmann AG. Spitzer said his investigation showed Sony BMG paid for vacation packages and electronics for radio programmers, paid for contest giveaways for listeners, paid some operational expenses of radio stations and hired middlemen known as independent promoters to provide illegal payments to radio stations to get more airplay for its artists. Spitzer also said e-mails among company executives showed top officials were aware of the payments. Spitzer said Sony BMG employees sought to conceal some payments by using fictitious contest winners to document the transactions. In one case, an employee of Sony's Epic label was trying to promote the group Audioslave to a station and asked: "WHAT DO I HAVE TO DO TO GET AUDIOSLAVE ON WKSS THIS WEEK?!!? Whatever you can dream up, I can make it happen." In another case, a promoter unhappy that Celine Dion's "I Drove All Night" was being played overnight on some stations threatened to revoke a trip to a Dion show in Las Vegas unless the play times improved. Sony BMG Music is an umbrella organization for several prominent record labels, including Arista Records, Columbia Records, Sony Music International and So So Def Records. Star artists signed with the Arista label alone include Aretha Franklin, Whitney Houston, OutKast, Pink and Sarah McLachlan. The $10 million will be distributed to not-for-profit entities and earmarked for music education programs, Spitzer said. Record companies can't offer financial incentives under a 1960 federal law that made it a crime punishable by a $10,000 fine and up to a year in prison to offer money or other inducements to give records airplay. The practice was called "payola," a contraction of "pay" and "Victrola" record players. The law was passed in response to the payola scandals of the 1950s and early 1960s that implicated some then-famous disc jockeys.

The Bronx to play Black Flag in upcoming Germs biopicThe Bronx has joined the cast of the Rhino Films production of What We Do Is Secret in Los Angeles. The band will be playing legendary hardcore act Black Flag and had this to say: We recorded “Police Story” last Saturday night at Radio Recorders in LA with Pat Smear. Kira from Black Flag stepped in on bass and told us how it was supposed to be done. Other acts include the Mae Shi as the Screamers, and the Germs as the Germs.[...] The Stitches and Pistol Grip will also be performing… as themselves. The film will be written and directed by Rodger Grossman and an early "teaser" trailer has been released and can be found here. The film was delayed indefinitely according to reports that surfaced a year ago, but work has apparently resumed.

Hardcore/Metal pioneers S.O.D. release retrospective DVD
Megaforce Records recently released 20 Years of Dysfunction, a retrospective DVD from S.O.D.
The DVD aims to include 3 hours of live concert footage and backstage antics featuring "The Ballad of INXS" and "The Ballad of Stone Temple Pilots." It will also include “Pussywhipped” on a bonus CD and extensive liner notes celebrating 20 years of the band. The label recently reissued the band's influential record, Speak English or Die and plans are underway for a new full length this winter.
